With respect to section 45 of the Courts of First Instance Act 32 of 1944, you hereby agree that CAPFIN may bring any legal action relating to this Agreement or your account in the Court of First Instance. You agree that we may bring an action in any court of first instance that has jurisdiction over you under section 28 of the Courts of First Instance Act. If for any reason we need to go to court under this Agreement, you must appear in a court of first instance. However, we may choose to sue you in any court of competent jurisdiction.
